I filed for divorce from my wife May 5 (Tennessee). I was served with a temporary OP the day before and was order to vacate my home with very little clothing. It has been 30 days and I have yet to get the remainder of my belongings. My attorney has attempted to get cooperation from my stbx's attorney via email and phone. Today I was told I they didn't want me to come in the house or even the drive because of the OP. Clothing would be placed at the end of the driveway. I told my attorney that this was unacceptable and that was only being used to delay, cause embarrassment, and undue duress. I asked her to file a motion for a hearing to get my personal valuables and belongings.
Also, to prevent further delay I asked my attorney to schedule mediation or compel the court to do so. I want this over as quick as possible and I made that perfectly clear with my attorney.
Even though I am only 30 days in my divorce I know how vindictive my stbx can be. What are some other things I can do to prevent their delay tactics? Should I ask the have the court to order scheduling?

On June 3, a month and half after being sentenced to life imprisonment,
Ilnaz Galyaviev was escorted to the Supreme court of Tatarstan again.
His lawyer, Ruslan Nuriakhmetov, applied for paying for his services. He asked to pay him 210184 rubles (roughly $2600) for 91 days of work. Answering the prosecutor's questions, the shooter said:
"I'm not able to pay off because I don't work anywhere. I need to cover the claims, so I can't pay."
"I haven't bought anything, I own nothing"
He also mentioned that he has 17000 rubles on his prison account.
The judge decided that Galyaviev has to pay 200000 rubles. For now Nuriakhmetov will receive the payment from the state budget, and Galyaviev will have to pay the debt later.
On May 11, 2021 19-year-old Ilnaz Galyaviev opened fire and detonated a bomb in his former school in Kazan, Tatarstan, Russia. 9 people were killed, including two teachers and seven eight-graders aged 14-15, what makes him the second deadliest school shooter to ever stand trial.
On April 13, 2023 he was sentenced to life imprisonment in a special regime colony and sued for 22 million rubles. Looks like it was done purposely to not let him get parole after 25 years with outstanding claims. Galyaviev said he will write a book to cover the claims, since he obviously will never pay for them in a lifetime considering the payment he will have in a colony.

2023.06.06 03:31 Trick-Acadia293 I’ve received an email from the Defendants lawyer, after we both represented Pro Se. Do I even respond?
On 4/26 I won a Judgment against my former employers, a husband and wife. This was after taking them to County Court, where we both represented ourselves. I was awarded principal, penalties, costs and post judgment interest. My costs were not calculated in totality in the Judgment and I’ve since filed a ‘Motion to Amend’ for costs and pre-judgment interest.
5/17 the Defendants sent a check for the principal amount, not including the post judgment interest. They included a total nasty gram with it, basically saying I play the victim and sue people for misunderstandings and I need to stop looking for ways to get money out of people.
I emailed them and said I would be filing a Motion for the additional costs and interest if they chose not to willfully pay it. The wife emailed me back after supposedly speaking to a lawyer who recommended they settle with me out of court. She said they would pay $459.16 for all the interest but none of the rest of the costs, if I signed a settlement agreement.
I told her I wouldn’t unless they paid the full amount I was asking for >$700. Days later she sends me a check for $16.08, her calculation of the post judgment interest. I filed my motion citing applicable law and all my costs on 5/30. I know this was not exactly timely but I was in negotiations essentially with the Defendants.
I’m unsure if the Judge will grant or deny it. I am just waiting now but just this evening I received an email from the Defendants apparent attorney.
He said the following, they owed $14.16 in post judgment interest not $16.08 and that my time to file the motion was 14 days after Judgment. My motion is without any basis in Colorado law and lacks substantial justification. He threatens that if he has to step in to respond to my Motion he will be asking the court to award his attorney’s fees.
I filed a partial satisfaction of judgment with my motion and he said if I do not file a full satisfaction of judgment by 6/9/23 he will enter his appearance in the case. He ends it off with ‘time is of the essence.’ Could you be a bigger douche?
The Defendants filed a counterclaim and it was dismissed. The Judge said their costs would not and could not be awarded because they lost. Is there really some way I could be responsible for their attorneys’ fees now? They’ve only just retained legal council.
I really don’t know how or if I should even respond to this guy. My boyfriend said it comes off like further harassment from them and not to respond. Can I provide this email to the courts? I included her letter in my motion to the Judge and asked for a ‘no contact order or restraining order’ if the court sees fit as I do not wish to have further correspondence with them.
I’m in way over my head and may need to reach out to legal counsel of my own. Any advice is appreciated though!

2023.06.06 02:57 Hanhonhon Does Andrew Jackson deserve to be a bottom 10 president?
I'll be honest, I had Andrew Jackson as a bottom 10 president for a long time but after considering his impact it makes me consider otherwise. I'm going to list his pros and cons, and say issues that can be interpreted as either. I don't like Jackson so I'm biased, but if there's anything that I am wrong about in the recall of events please say so. And you're not a bad person for thinking he was a good president
Pros:
First of all Jackson was the first "common man" president which was absolutely huge in the American public identifying themselves with political figures and participating in it. America in the beginning was an oligarchy where white men with property could vote but the Jacksonian era was a major push to include all white males 21 and up which included millions of people
You can argue that it led to increased white supremacy in the states (which I believe was going to persist anyway), it was a massive push for democracy. I would say this is his biggest accomplishment
Despite Jackson being pro-states rights on a lot of things, the South Carolina dispute showed that the States can't override (nullify) federal law which likely prevented major conflict or the union dissolving much sooner. Was it a push towards civil war? Sure but I think the conflict was inevitable
- Lowered Tariff of Abomination (1828) rates
I don't know a whole lot about tariffs or how it affected the 19th century economy but from my understanding it was a good thing
- Improved British relations with the US
Jackson was the first to secure treaties and trade status with the country and the British West Indies territories which helped in the economic boom in the 1830s. US ports became open to British vessels too
- Out of the first seven presidents he spent the most money on infrastructure by far
Which is kind of weird considering he was generally against big government but a lot of the actions were politically motivated, like vetoing Henry Clay's Maysville Road
- Jackson was one of the most effective presidents of all time
Whether or not you like all of the policies (which I certainly don't), you can give credit to a guy who does what he says he is going to do
Not really a pro but personality wise he was a badass and an insane person. Probably the craziest president as he had a strong bloodlust, and he survived a duel where he allowed the opponent to shoot him first, then Jackson shoots back to kill him.
Cons:
- Trail of Tears and Indian Removal Acts
Pretty obvious one there, thousands of Cherokees dead and tens of thousands forcibly displaced. And it's not like he reluctantly signed it or it was overwhelmingly supported by congress, he was all for Indian removal and went against Supreme Court who said that the government doesn't have the right to possession of Indian lands, for this Jackson said "Let's see them enforce it" (Worcester vs Georgia). This also supports the idea that Jackson was a tyrant
- Paying off the national debt
It's frequently said to be a good thing but it wasn't, not only did it directly lead to the Panic of 1837 and the inflation of paper money, but the surplus money was distributed corruptly amongst state pet banks who weren't Whig. I wont say that Jackson directly caused the economic depression to happen but it solidified it because the banks didn't have enough hard currency after paying off Federal lands. The British were also prepared to have American credit too
You can argue that Jackson getting Roger Taney to remove BOTUS II funds to pay off government bills, or to distribute them into state banks during Senate Recess was illegal, as it caused Jackson to get censured and was the only president in history to undergo it.
Jackson wanted to get rid of federal officials who were allegedly corrupt in previous administrations and to avoid a meritocracy. While previous presidents had involved some form of patronage in their administrations, Jackson was the biggest one who got rid of nearly 1000 officials which set a precent to devolve civil service into cronyism. Leading to corruption down the road to be eventually reformed by gilded age Republican presidents
Debatable Issues:
- Being opposed to the Second Bank of the United States
Honestly I don't know enough about econ to say whether its good or bad but my general impression was that Jackson had a point in how the government was handling BOTUS II in which it was benefitting rich people only, but how he handled the dismantling of the bank was bad. But if you know more about it, definitely weigh in on it
- Being the face of the Democratic Party
I would argue the Democrats being bad throughout the 19th century as they were pro slavery/pro Jim Crow racists. But we would have modern politics without Andrew Jackson, and the Whigs were created because of their opposition to Jackson
So what's your take on Jackson? Does his accomplishments lift him out of the bottom 10 through sheer impact or does he belong amongst the worst?

2023.06.06 02:42 TizitTho What to evidence to bring to court when other parent is objecting to Child Support recommendation
I've been separated since August 2019 and divorced since June 2021. Up until February 2023, I have had 50/50 custody and my ex has paid me a very small amount of child support for two children.
My ex has always struggled with undiagnosed mental health issues since we met in 2010. It comes in waves. For a couple of years, he will be fine but out of nowhere he will become manic and go completely off the rails. He will quit his job, burn bridges, disappear for days, etc. This will last around 6 months. Then he'll get his shit together again and be fine. It's cyclical. In November 2022, he started cycling again and it caught up to him in February 2023 when he was picked up by the police and institutionalized for several weeks.
To protect myself and my children, I immediately filed an ex parte motion to suspend his parenting time. It's been suspended since. I filed paperwork to get child support recalculated because I have the children 100 percent of the time now. It took almost 3 months for them to send in a recommendation. On the last day before the recommendation took effect, he objected and now the court date is this week.
He claims he can't pay what the friend of the court is recommending because he is unemployed (he quit his job in January). He is unemployed because he "hasn't been able to find gainful employment". (He is a graphic designer.) He also said he can't work because he has mental health issues. His lawyer didn't submit any evidence to support any of these claims.
He hasn't paid ANY child support since February. I allow him to see the children once a week, supervised, for a few hours. My kids love their dad and I don't want to punish them because their dad is a dingleberry.
My question is: what should I bring as evidence? I have the following:
- Texts from when he told me he went to help his friend work in another part of the state
- Texts indicating that he "has plenty of work"
- Indeed job postings for graphic designers (I searched and there is literally 50 in our area)
What am I missing?
Just as an aside, I work more than fulltime, live in a 750 sqft apt with my two children, and have an 8 year old car and am barely making ends meet. He lives in a 1500 sqft house, paying on a mortgage that is less than half of my rent, and is driving a new car. He still owes me $75,000 from our divorce agreement. I played nice during my divorce and got played. I want to make sure I don't make the same mistake. I cannot afford a lawyer so I'm doing this on my own.

Curious what will be discussed at this Fridays Status Conference in Juniors case. Obviously the status of his guilty plea filed recently in the motion put before the court by his new attorneys. Also his sentencing I suspect. I wonder what else?
I had a thought and wanted to share. Junior is pleading guilty to 25 counts of CSAM and obstructing Justice. Serious stuff. He’s pleading guilty to all of it with no promises. Nothing. He’s literally throwing himself at the mercy of the judge, whom I assume will be deciding his sentence.
There’s always been talk of whether Junior made this, or that, deal with respect to Abby and Libby’s murders. I think he gave law enforcement a statement regarding his involvement in the murders, and what he knows happened that day in Delphi. As incredible as that sounds, I think it’s nothing new to this guy. Look at what he did that day they raided the house he shared with his dad. He immediately started talking to the FBI agent that interviewed him that day. He told her he knew he had a problem. He acts like he didn’t know he was breaking any laws, but we all know he knows he was breaking laws by exploiting the underaged girls for photos and videos. But here he was talking to the FBI agent and admitting he knew it was a problem— essentially saying I’m guilty. I’m sure he was given his right to an attorney and he agreed to keep talking. I’m also sure they have it all on tape, including his disastrous polygraph examination he agreed to take. I suspect he honestly had no clue the kinds of questions they would ask him. He failed twice when asked if he knew who killed Abby and Libby. They knew right then and there he knew— he knew the killer.
So here he was on February 25, 2017 admitting to the the CSAM they were finding on those devices seized from inside that house. No worries about where each device was found inside that house. Whether it was an old iPhone 4 found in his dads bedroom (I’m speculating), with his dads DNA and greasy fingerprints all over it, or they found it in his bedroom. He’s not waiting for the investigation— he’s telling the FBI agent yeah those are my old devices I’m guilty- I promise to stop. Incredible stuff.
Now fast forward to August 2022. The 2 year anniversary for Juniors arrest is fast approaching. Junior is all comfortable living on Cheetos, Twinkie’s and county jail food. Most guys would be screaming to get out— not Junior, he’s now this quasi celebrity criminal with everybody in the county pedo pad fawning over him— filling him with his favorite orange puffed treats. Making me think of that Zach Bryan song Something in the Orange roll around in my head..

Investigators needed a statement from Junior. He readily admitted to all the CSAM—no attorney necessary. There was never going to be a trial— he’s on tape admitting his crimes that he knows he committed He’s a unique criminal— he pled guilty with no promises back on February 25, 2017. Now all they had to do was get him to talk about Delphi. He hadn’t been as forthcoming to investigators with what he knew about that day. They knew he knew something. They also knew his biggest fear was taking the full blame for the murders of Abby and Libby. Just read his post arrest interrogation transcript from August 19, 2020 and you will know what I’m taking about.
Last August 2022 investigators lit a fire under Juniors ass (sorry for that visual). They stoked the proverbial fire— they lit that match. The investigators decided Junior needed some shaking up— he was too damn comfortable living in a county jail. Who knew that would happen. He could easily wait out three-four years, and by the time they get to a trial— he’s already done his sentence. He walks out of jail and they lose their leverage. He’s back where it’s harder to get him to talk— which has been the plan of arresting him and getting him alone for all that disgusting CSAM found in the house shared by both Junior and his daddy. Keep him away from his daddy’s bad influence. That was the plan.
They created the ruse about someone having looked up that Marathon gas station. Not only that— but the FBI lost all the security video from that day. No way to prove he was never there that day— that thought had to rattle through Juniors head. He’s going to take all the blame for the murders— it was his biggest fear. investigators played him like a cheap fiddle and he never knew it. Create fake story— tip the MS couple— shake Junior and get him to talk. There had to have been a undercover man in that county jail stoking that fire- and giving Junior lots of Twinkies.
It worked and just like he did with the CSAM— he made a statement with no guarantees from anyone. Sound incredible? It happens all the time across this country. Junior is throwing himself on the mercy of a judge— who I suspect will soon sentence him for the CSAM. And possibly someday for his involvement in the murders of Abby and Libby. No 12 of his peers from a local pool of jurists— just the judge deciding his fate. It’s possible his chances are much better with an impartial judge— than risk judgement by a group of moms and dads, sisters and brothers and of course grandparents who aren’t going to be very forgiving.
10 days and we get a new look at Allen. My money says he’s still all mopey and depressed..

I was busted by the light police. They had a point, Dana Milbank of the Washington Post. Dana Milbank purchased a home in,
soon to be not, rural Virginia. At night he kept the formerly vacant property lit to the degree that spurned one commentator to call it “spaceship lighting.”
Milbank recaps being visited by the “light police,” a group of concerned citizens who help educate neighbors and instill a sense of pride in the brilliance of their starry night skies.
At first, he was taken aback, but later, not only did he appreciate their efforts, but he also converted his blinding always on, white light flood lights to warm 2700 Kelvin motion sensing lights.
Per Ruskin Hartley, executive director of the International Dark Sky Association, “for 4.5 billion years there was no artificial light at night. It’s really only in the last five human generations that we transformed that. It’s one of the most profound transformations of our environment.”
Many of you may recall an earlier story, way back in our Hormone of Darkness episode, showcasing concerns by local residents prior to a 760 house (now 761) plus town center development moving into the Culpepper County, VA area. Per the
Rappahannock News, this development features “a resort style swimming pool, clubhouse, tot lot, and multiple sports fields and sports courts, all connected by a network of biking and walking trails.”
The forgotten medieval habit of ‘two sleeps’ by Zaria Gorvett of the BBC. Gorvett opened my eyes to something I never knew about, the medieval custom of two sleeps. For those of you unaware, two sleeps are exactly what it sounds like.
Folks would partake in a communal nap, complete with rigid sleeping arrangement conventions, between 9 – 11pm, then awaken for a few hours to do everything from hang out to brew beer! In fact, the idea of multiple sleeps crossed cultures and was found in places as far from Europe as indigenous South America.
How can one’s circadian rhythm make sense of all of this?!
Well, for starters, until the invention of the alarm clock, which humorously was invented by a clocks salesman so he could wake up and sell more clocks, people had no firm way to wake up at a consistent time. The industrial revolution enforced a new circadian standard.
And there’s some science behind this! In the 1992 study,
In Short Photoperiods, human sleep is biphasic, researcher Thomas Wehr found that after four weeks of 10 hour days, his subjects began to engage in this two sleep cycle, involving a one to three hour period for which they became awake and engaged in between.

Evidently gambling websites have decided to honor April’s International Dark Sky week in a strange new content marketing campaign, which was to rank the best places in each state to see sunrises and sunsets. My favorite one, “Ann Arbor named best place for sunrises, sunsets in Michigan,” comes from Click on Detroit, whereby a quote “study” examined Michigan’s most populated cities.”

Astrology Day on Saturday, staff at Great Lake Stakes, a Michigan online gambling news site, looked at light pollution in the five most populated cities around the Mitten state to determine which offers the best views every morning and evening.”
Star bathing is the new outdoor travel trend we should all be trying for Summer 2023, according to Amy Beecham at Stylist. Evidently, as an attempt to destress and promote mindfulness, romanticism about sleeping under the stars has birthed a 70% increase in searches for the term ‘star bathing’ on Hipcamp. And to be sure, “Hipcamp recommends checking a stargazing calendar which outlines major
astrological events – like supermoons, pink moons, and star showers.”
“Industry Must Face an Inconvenient Truth — Most LED Lights at Night are Unhealthy” Dr. Martin Moore-Ede, a circadian clock expert, recently published an article in LEDs Magazine chastising the lighting industry for not recognizing and reigning in the negative externalities of its products. Per the piece, such effects are, obesity, diabetes, depression, cancer, and more.
He cites three categories of industry responses, making the correlation that long term Denial or outright Ignorance of the Facts, may result in “asbestos-scale liabilities or draconian regulations.”
Per the piece, a recent survey by the Circadian Light Research Center of 2,697 peer reviewed scientific articles confirmed that human circadian clocks are highly sensitive to blue wavelengths, and that exposure to such wavelengths leads to major health disorders.
Moore-Ede calls for the industry to harvest the “commercial opportunity” to greatly limit future liability by creating and managing its own standards for circadian modulated lighting.
Unpacking the Wallpack, by Dan Weissman in LD+A Magazine. Weissman, who recently purchased a telescope for his family in Cambridge, MA, discovered that the scope could only afford him views of some solar system objects and a few brightly burning stars.
The ire of Weissman’s pen takes the shape of a rectangular fixtures, be it box like or simply a panel these days, that typically hang off the side of an exterior wall or above an exterior door. “Devoid of aesthetic value” this light is often put up under the “pretense of security and safety” by “recommended practices and adopted municipal codes.”
Weissman recognizes labels that often accompany, what he calls, “Glare bombs,” including “contractor-select,” “energy efficient,” or “light pollution friendly.”
Further, per an earlier LD+A article, such lighting driven by its extreme contrasts is exceedingly common in minority communities where light is weaponized as a tool of power. It becomes a “device of alienation, creating a zone of control and separation.”
Weissman recognizes that the true reason such fixtures are selected often comes down to cost. He recognizes that it may take equally as much cost to persuade building and homeowners away from such lighting into the realm of more responsible, lower lumen, shielded lighting.
Weissman calls for producers of these glare bombs to be labeled as polluters, putting them in line with fossil fuel manufacturers and PFAS makers.
Songbirds, dusk and clear skies: Scientists explore migratory flights, by Erin Blakemore. Bird migration season is ending here in the Mid-Atlantic. I was lucky enough to catch several Baltimore Orioles and Indigo Buntings last week. Researchers looked at 400 songbirds from 9 major species, “including the yellow-rump warbler, American redstart and Bicknell’s thrush.”
The question they hoped to answer was how are these birds so darn precise in identifying the best time to take off for their nightly migration? Scientists found that 90% of the migrating birds in the study took off within 69 minutes of dusk. A “much narrower takeoff window,” that even shocked the research team!
Per the study, taking off at night is all about maximum flight time. In addition to being able to precisely schedule their take offs,
a feat that every airline I’ve flown with over the past few years has proven inept at, birds also are apparently good meteorologists! They often depart when the atmospheric pressure rises over a day’s span. Other factors also trigger migration, including sex, age, and
celestial cues.
‘Lights Out’ initiative appears to be saving birds from crashing into Philly buildings by Sophia Schmidt. Preliminary results indicate that bird death counts are down 70% at one Market Street tower, since it began its participation in Lights Out. As we spoke about on a previous show, birds utilize the stars to navigate, but city lights can disorient the birds. Combine the lights with reflective or transparent glass, and that spells fatal trouble for our migrating warblers!
Per Keith Russell, a program manager for urban conservation with Audubon Mid-Atlantic, “We’ve lost almost a third of our birds – and [collisions] contributing to that. If we’re going to want to preserve the bird populations here in North America, we have to look at these types of problems. And this is a preventable one.”
The Knoxville, TN Zoo is offering up what they call “Twilight Tours” per WVLT 8. Each event will feature a guide to showcase nocturnal critters.
I did something similar in Singapore years ago. The zoo had very dim lights in the exhibits – and they kept those lights dim as you walked so that you didn’t lose your night vision. It was a very different and, might I say, peaceful experience than the typically chaotic daytime zoo.
Flashlights posing major threat to nesting sea turtles. Fox35 Orlando Apparently, a single flashlight can deter female sea turtles from coming onto a beach and nesting. Florida, as I did not know, is home to 90% of the sea turtle nests across the world, so losing sea turtles can affect the global ecosystem.
One visitor to Cocoa Beach stated, “Just leave them alone. Stand back and look. You don’t need a flashlight.”
Another, “It’s not super surprising because more buildings go up, more technology. As it increases, nature and stuff like that decreases,” said Zoe Jovaag, whose grandfather used to take her on walks to see sea turtles.

However, it will only change to green if the car is going the speed limit.
Per the Jalopnik article, “FRED [the French acronym for “educational traffic calming light] forces fast drivers to stop and gives them a chance to reconsider their life choices.” Such lights are already used in Europe, but this will be the first for the Great White North.
Why the Greatest Threat to Star-Gazing Isn’t Light Pollution, and this comes to us from Dorin Elin Urrutia at Inverse. Elin Urrutia writes, in her compelling piece, that the greatest threat to star-gazing is actually the weather. Citing notable examples of the Mount Stromlo Observatory in Australia (which burnt down due to bushfires) and the Arecibo Observatory in Puerto Rico (which sustained structural damage following the winds of Hurricane Maria).
While the threat of human-caused climate change has presented new challenges, Elin Urrutia references proactive burns that saved Los Angeles’ Mount Wilson Observatory from flames in 2020.
On a similar note, ABC News (the Australian Broadcasting Company, not to be confused with the American Broadcasting Company), brings us “A World Without Darkness Could Be a Reality within a Few Years.” Per Carol Redford of Astrotourism Western Australia, “There are some people in the world now who don’t actually experience darkness anymore. They’re in a city like Beijing, Toyoko, or London. In all those big cities, it’s never dark, it’s always light. During the day of course with the sun, but then during the night with all of the artificial light. They’re not experiencing darkness, and definitely not seeing those beautiful stars…”

The town of Swam Reach, population 270, resides in a 3200sq km region of Southern Australia that received its International Dark Sky Reserve status over three years ago. On a scale of darkness between 0 – 22, the River Murray Dark Sky Reserve at Swam Reach, measures in at a whopping 21.9!
Tourism has become a growing business. The reserve hosts numerous telescope pads and offers tours of the night sky. There’s hope that an observatory and/or planetarium may also arrive in due course.

You know, it’s astounding when you look at some of these pictures. The amount of redundant lighting. It honestly makes no sense to me. You have a porch light, which lights up the path. Path lighting, which lights up the path. And, in the one picture, god awful frontward facing flood lights, which also light up the path. How bright do you need these paths!? I digress. But the lumens are indeed coming.
LDS Church will get to light up its Heber Valley Temple after all, but the faith didn’t get everything it wanted, Blake Apgar of the Salt Lake Tribune. The Church of Jesus Christ of Latter-day Saints fought hard to rid itself of any nighttime lighting responsibility by pressuring Wasatch County, Utah officials to approve new lighting rules that would enable the church to light a proposed new temple the same way it does for every other temple.
The Church received permission to uplight the temple, enabling an exception to be made in Wasatch’s rather stringent nighttime lighting rulebook. However, the temple will be restricted by the level of lumens it can use, and it must have exterior lighting turned off an hour after sunset or an hour after normal business hours.

Nighttime is alive and well in some parts of Texas!
Our Afraid of the Dark article is a bit scary! Hilton Head’s dark roads and pedestrians are deadly combo. What the town is doing about it, Blake Douglas at The Island Packet. Per the article, 9 pedestrian and cyclist fatalities occurred since 2018, with five occurring after dark. Prior to that period, there were 28 recorded deaths from 2000 – 2016, with 20 of them taking place after dark.
In 2018, an 11 year old resident was struck and killed while walking her dog across an intersection one night. Lighting advocates began taking shape in what otherwise is a very conservation focused island. Hilton Head, SC has a limited number of street lights, priding itself on “avoiding light pollution and blending nature with construction.”
Lighting advocates appear to be, at the very least, asking for flashing crosswalk lights on the island to indicate when an individual is crossing.
It should be noted that the article shows a chart of 9 after-dark-deaths since 2014, only two of them occurred at crosswalks. In fact, during the same time frame, 6 additional deaths occurred
at crosswalks during the
daytime.
As a whole, the National Safety Council reports that 74.5% of pedestrian deaths occurred at night, whereby
39.1% took place in lit areas and 35.38% took place in unlit areas.
Bryan Bloch, an auto safety expert, surmises that car companies bear some of the blame – producing cheap or ineffectual headlight fixtures, and drivers themselves, who don’t realize that they need to regularly clean their headlight lenses.
Despite opposition from residents, it appears that Hilton Head will be receiving lights at two new intersections and possibly more depending on engineering studies currently in progress.
Is lighting the key variable here? Is more light going to solve pedestrian deaths?
Our featured research article of the month comes to us from Animal Conservation, “Manipulating spectra of artificial light affects movement patterns of bats along ecological corridors.” Bats are already known to have a wide range of responses to artificial light at night (also known as ALAN). Fast flying species tend to be more opportunistic in the presence of ALAN while slower ones tend to be more light averse. We know that “long wavelengths and reduced intensity” can minimize their environmental effects on bats. It’s not unheard of for bats to travel upwards of “tens of km per night.” Furthermore, bats are very dependent on the landscape and the structures within those landscapes.
Despite the nuances between species, the consensus is that ALAN, especially high intensity ALAN, negatively affects bats. This study attempted to answer what exactly bats do when they encounter ALAN – how do they react depending on different types of ALAN.
The study used three different light fixtures – one green, one red, and one white. The control was devoid of light fixtures. The researchers attempted to ascertain the behavior of bats as they encountered lights adjacent to woody areas. The researchers looked at three different bat groupings based on their foraging-echo location behavior, that being one of open field foraging, forest edge foraging, and narrow space – or more aptly forest foragers.
Researchers found that open and edge foraging bats increased their activity close to white and green lights, and to a lesser extent red lights. However, narrow space bats were more likely to veer away from all colors of lighting. Edge foragers were also less likely to cross a white light.
The positive effects of white and green light on open and edge foraging bats appear to be attributed to the accumulation of insects around light sources containing more blue light.

http://under-these-restless-skies.blogspot.com/2014/02/henry-percy-anne-boleyns-first-love.html If things had transpired just a little differently, Anne Boleyn might have gotten married in 1522 and lived out her life quietly as the Countess of Northumberland.
Henry Percy was born in 1502, the eldest son of the Earl of Northumberland. As a young boy, he was sent to the household of Cardinal Wolsey. He rose in the ranks until he was one of Wolsey's secretaries. When the cardinal went to court, wrote Wolsey's biographer,
George Cavendish, Percy would linger with the ladies in the queen's chamber. That's where he met Anne Boleyn.
We know Anne was at court by February 1522, because she is recorded as playing the part of Perseverance in a court masque. It's believed Anne had been recalled from the French court because her
father was negotiating her marriage with James Butler, Earl of Ormond. Anne's father and Ormond had an ongoing inheritance dispute that the marriage was intended to solve.
Anne Boleyn's grandmother was Lady Margaret Butler, daughter of the 7th Earl of Ormond. When he died, he had no sons, and so the daughters split the inheritance. Thomas Boleyn felt he should have inherited the Ormond title through his mother, but a cousin actually living on the lands, Piers Butler, more-or-less claimed the title for his own, and there wasn't much Thomas Boleyn could do about it, considering Piers Butler had the backing of the Irish lords.
Wolsey had the idea of marrying Anne to Piers Butler's son, James, was a way of settling the dispute. It's uncertain of whether Anne knew about these negotiations at the time.
Cavendish says she didn't, and from what we know of Anne's moral standards, she wouldn't have begun a relationship with Percy if she knew she was about to be married to another man.
Just how far this relationship went is a matter of speculation. Cavendish writes that a secret love grew between them, and they agreed to marry.
In the Tudor era, a betrothal was legally binding. It could be as simple as saying in front of witnesses that the couple intended to marry, or for the upper classes, drawing up contracts which detailed the financial obligations involved. Subsequent marriages were invalid if it was determined that either party had been pre-contracted to another person without it being invalidated by a papal dispensation. While a betrothal could be broken, leaving the couple free to marry another, a betrothal with a consummation afterwards was much more difficult to dispense with, which is why Henry VIII had a proxy consummation after the proxy betrothal of his sister,
Mary Tudor Brandon.
Did Anne and Percy ever say the "magic words?" Both later swore that there had never been a legally binding betrothal between them. Both of them were trained courtiers who knew how to communicate without
technically ever saying dangerous words. It's entirely possible they had an understanding without ever crossing that line.
Cavendish claims it was the king who discovered the relationship and ordered Wolsey to break it off because he wanted Anne for himself. But all evidence points to the king becoming interested in Anne around
1526, years after this incident occurs.
In reality, it was likely Anne's father and the cardinal who put a stop to the match. The cardinal would likely have been concerned at seeing the solution to the irksome Boleyn-Butler inheritance issue being dismantled, and Thomas Boleyn likely wouldn't have wanted to see his daughter entangled with a man of high title, but low financial prospects. Percy's family also had a match in mind for him, and were likely displeased he was putting that at risk.
Cavendish records that Wolsey summoned Percy and chastised him in front of a hall full of servants, and disparaged Anne - something he was unlikely to do if the king was actually driving the situation because of his own interest in Anne.
I marvel not a little of thy peevish folly, that thou wouldest tangle and ensure thyself with a foolish girl yonder in the court, I mean Anne Boleyn. Dost thou not consider the estate that God hath called thee unto in this world? For after the death of thy noble father, thou art most like to inherit and possess one of the most worthiest earldoms of this realm. [...] Ye have not only offended your natural father, but also your most gracious sovereign lord, and matched yourself with one, such as neither the king, nor yet your father will be agreeable with the matter.
And hereof I put you out of doubt, that I will send for your father, and at his coming, he shall either break this unadvised contract, or else disinherit thee for ever. The king's majesty himself will complain to thy father on thee, and require no less at his hands than I have said; whose Highness intended to have preferred [betrothed] her unto another person, with whom the king hath travailed already, and being almost at a point with the same person, although she knoweth it not, yet hath the king, most like a politic and prudent prince, conveyed the matter in such sort, that she, upon the king's motion, will be, I doubt not, right glad and agreeable to the same.
According to Cavendish, Percy wept and protested:
... in this matter I have gone so far, before many so worthy witnesses, that I know not how to avoid myself nor to discharge my conscience.
Wolsey then responded that he and the king knew what to do in such circumstances, and ordered Percy never to speak to Anne again or face the wrath of the king.
Anne was sent home to Hever for about a year, and Percy was married to Mary Talbot after a long period of negotiation.
Percy's marriage to Mary Talbot was not a happy one. Their families had been planning the marriage since 1516, but it wasn't concluded until after the Anne Boleyn incident. We're unsure of the date - it occurred sometime between 1523 and 1526. Gerald Brenan, author of
The House of Percy says that there was a mutual dislike between the couple from the start.
Percy submitted to the union, and was "
sick in mind and body." It sounds like he was depressed over his situation. His earldom was broke, in deep debt to the crown. Percy surrendered the responsibility for managing his estates and finances to Wolsey. The cardinal received the income from it to pay the debts and gave the couple a pitifully meager allowance to live on. The financial pressures could not have helped the situation between Percy and his wife.
According to Brenan, the locals resented Percy for his perceived lack of generosity toward them, and so he and his wife were unpopular with their people. Wolsey employed the servants - and possibly even Percy's new wife - as spies to keep a close eye on Percy's activities. Brenan writes that they lied to the cardinal about Percy's spendthrift ways, and so Percy was constantly harangued with chastising letters.
Worse, Percy was faced with insurgents and outlaws on the borders of his lands that he was expected to combat and bring to heel. Organizing force against them was one thing, but when he had to execute them, it was quite another. One young boy stirred his pity, but he feared his own influence wasn't enough to obtain mercy. He entreated friends to approach the king on his behalf. They were successful and the boy's life was spared, but this got Percy in further difficulty with Wolsey.
You should not use so cantellous and colourable dealing with one that thus tenderly hath brought you up and set you forward...
Like his health, Percy's relationship with his wife, Mary Talbot, never improved. In 1529, she became pregnant and fled back to her father's home. Her child was stillborn, and Mary herself almost died. Wolsey persuaded her to return to her husband after she recovered, but Mary became convinced that Percy was going to have her poisoned.
Wolsey never had a chance to sort out that one because the king decided the cardinal wasn't working in his best interest to get him the annulment he wanted so he could marry Anne Boleyn. Percy was the one sent to arrest the cardinal, the man who had managed his affairs and treated him like a child all of these years. By all accounts, Percy treated Wolsey kindly as he escorted the cardinal toward what would probably have been his doom. But Wolsey died before he could face the king's "justice."
Soon afterward, Mary Talbot sought an annulment of her own, having gone back to her father's house again. Apparently, during one of her quarrels with her husband, Percy had mentioned he had once wanted to marry Anne Boleyn. Mary took that as an admission of a pre-contract between himself and Anne, and if she could force the issue, it might be a way out of her detested marriage.
Anne Boleyn decided to confront the matter head on, and asked the king to launch an investigation into it. Percy was summoned before the council. There, before the Archbishop of Canterbury, he solemnly denied there had been a betrothal between himself and Anne Boleyn.
Was he telling the truth? Some writers have posited that Percy gallantly denied his betrothal to Anne so she could marry the king, even though it meant condemning himself to continue a hellacious marriage with his hated wife. But the real answer is likely more mundane. Anne and Percy probably had an
understanding, but didn't go so far as to technically commit themselves. Percy swore it on the sacrament, which wasn't a thing undertaken lightly in those days. It's highly unlikely he would have lied on the host and risked the damnation of his soul.
Only a scant three years after Anne's marriage, she was charged with
adultery and treason. As a peer, Percy was summoned to be a juror in her trial. Percy had to know she was doomed, just like the cardinal he had escorted a few years before, and there was nothing he could do to save her. What emotional cost this may have had to him, we will never know, but it is recorded that after he said the required word, "
guilty," he collapsed and had to be carried from the court.
His ordeal was not over. After the jury dutifully found Anne guilty, the king decided he wanted an annulment. His marriage would be ended by a blade in only a few short days, but Henry was determined to erase the marriage completely and bastardize his daughter, Elizabeth, too. (Ironically, if Anne was never married to Henry, she couldn't have committed adultery, but no one stopped to question that little technicality.) Percy was dragged out again and asked whether or not there was a pre-contract. This time, there was likely a good deal of pressure on Percy to "admit" there was. Percy held firm. He wrote a statement, addressed to Cromwell:
I perceave by Sir Reginald Carneby that ther is a supposed Pre-contract between the Queen and me. Wherfor I was not only examined upon my othe before the Archbishoppes of Canterburie and York, but also reccaved the blessed Sacrament upon the sayme, before the Duke of Norfolk, and others of the Kynges hignes Council learned in spiritual law; assuring you, Mr. Secretary, by the said othe and bessed bodye, which affore I receaved, and herafter entend to receave, that the same may be to my damnation if there were any contract or promise of marriage betweane her and me.
At Newingtone Grene, the XII daye of May, in the 28th year of the reigne of our Soveraigne Lord, King Henry the VIII. Your assured NORTHUMBERLAND.
It ultimately didn't matter. What the king wanted, he would get. Cranmer was sent to the Tower to speak to Anne and emerged with the "evidence" he needed to annul the king's marriage. What it was is unknown. The document merely states that she admitted to an impediment that was "unknown" to the king at the time of their marriage.
Anne
died stripped of her title of queen, stripped of her title as wife. She was, once again, Anne Boleyn, as she had been in those heady days of 1522, when Percy had fallen in love with the girl who had beautiful black eyes.

2023.06.05 23:52 pgtvgaming [NJ Monmouth County] Def physically abused my children. There is a dcpp substantiation of physical abuse and criminal child endangerment charges - i am pro se and need advice / attorney to safeguard my children as Def is seeking reunification.
There is a lot going on here - my hope is to ask the court for a reconsideration as judge ordered a reunification plan to be submitted by dcpp over the next two weeks, in light of def appeal of the phys abuse substantiation and criminal charges. She has not taken responsibility for her conduct.
Thoughts/feedback appreciated.

2023.06.05 23:40 Aspiringcatlady_5 Am I being ungrateful? Dad always asks for large sums of money, I'm sick of giving it to him
My half-sister, lisa (not real name) thinks I (24f) should stop keeping count and give my dad money without expecting it back because "he's old" and making money doing delivery is hard. She doesn't live with us anymore, she's married, but i guess my dad helps her out when she's in a difficult situation. My Dad does UbeGrubhub, etc as his job because the business he had for years fell through like 7/8 years ago. I keep suggesting he gets a job working for someone else while doing the delivery on the side. He refuses because "he can't work for anyone else and would need at least $30 an hour." He did not get the chance to get his degree after immigrating to America because he had to take care of the four of us. During this time my dad ruined my brother's (David) credit score when he was younger by opening cards in his name and not paying the bill. He finally got everything removed from David's credit report last year.
My dad is married. However, he feels like he cannot go to his wife /family for help in addition to the bills she helps with because of his pride, she tells her family everything, and gives him an ugly face. Why would you marry someone like that? His wife does agree with me that he should get another job.
I live with my dad, his wife, and one of my half-brothers (Tyler). His wife helps pay bills. My brother doesn't make enough money according to my dad and doesn't give him money every month for his part of the rent. I pay my rent and phone bill in addition to my own bills. I wouldn't mind paying extra bills. This issue is he's not asking for an extra $200/ $300 for bills, he is asking for $1500+ "loans" that he "pays back" in a deduction from rent. I do give him the $100 - $200 if he really needs it.
This has been an issue since I was in college, I paid off his and david's car taxes, only $600 okay sure. Then I paid the full rent in college once - $2000 (it was leftover financial aid, I was still salty.) Then I paid $1500 for his wife's lawyer fees (he did pay this back after 6 months.) However, I then paid the full rent ($1700) because he hasn't gone on a vacation for a while and wanted to go back to our home country with his wife. I haven't gotten this one back yet. He asked me for an additional $650 today for his care insurance or he can't keep working. My dad got a new car instead of a bucket car for deliveries so his car note is $500 expense he can't afford. I'm over it at this point so I suggested that we all just give him $160 to cover it. This is when my sister goes on her rant. Lisa can't because she can't afford to right now. Tyler ignored it and doesn't make enough money. David is the only one that remotely said he'd pitch in. My dad owes him around $400.
My brother and I are fully related, it seems like we are his primary target to act as his ATM.
I am going to lose state insurance most likely and I might have to throw the majority of my savings towards my student loans if the supreme court doesn't grant the forgiveness (i'll still owe money). My view is that if I never ask for my money back, my savings would be shit trying to keep up with his poor decisions. It's hard to want to help out more when he refuses to get another job that would alleviate stress. I'd be paying my bills, rent, and additional bills because Tyler can't, then give whenever he can't afford it.
Tons of people still live with their parents and don't deal with this. He should be able to go to his wife. She recently went on a trip and spent all her money. Am I ungrateful for not wanting to give the $650 without their help just because I live at home still? I know $1700 is some people's rent so I guess I shouldn't complain, but still, I feel gaslighted. He's just going to keep doing it. I'd be happy to pay another $300/$400 a month if I got the money I'm owed so it starts over fresh.
